Policy Statement

This policy sets out the values, principles and policies underpinning this Headzpace’s approach to the wider issues of Service users rights, associated risks, and use of legitimate means of restraint. Headzpace’s restraint policies are integral to its overall approach to the safeguarding of vulnerable service users.

The purpose of this policy is to ensure that all service users and staff are aware of their respective human rights and responsibilities particularly in relation to the potential use of restraints and actions that restrain the service user’s freedom of movement and action. The policy is written in line with a wide selection of legislation, which includes the Human Rights Act 1998, the Equality Act 2010, the Mental Capacity Act 2005, the Health and Social Care Act 2008 and current Care Quality Commission guidance.

Headzpace follows the principles of encouraging and supporting its service users to lead appropriate and fulfilling lifestyles in and outside the placement. This entails being able to participate as fully as they wish and can in the wider community and social activities, including political processes. The standards also stress that service users should have the same rights as anyone else in society and their legal and political rights need to be protected.
